I can't speak for the Mayor or Theresa, but the legal department does still believe there is enough confusion, real or potential, given the closeness of the names and the fact that one is government sponsored, the other not connected at all, that some separation would be advisable.

As you may not have noticed, the item removed from the agenda had two parts.  The second was the potential letter, the first was a suggestion that the Town change the name of its newsletter to "The Athertonian, Official Newsletter of the Town of Atherton" or similar distinct clarification.  That's pretty clear.  We also will be recommending that all of our websites contain no links to any non-Town website or group of any kind, and where some potential for confusion exists, such as Athertonians v. The Athertonian, we are certainly free to place disclaimers on any or all of our websites that Athertonians is not affiliated with the Town in any way.  If the group is not willing to even discuss name revisions for the sake of clarity only, then we believe the Town should step up and make the distinction on its own.  We seek to avoid any future confusion where some liability might arise and the user claims that they thought it was a Town affiliated site, and this appears to be the best way to do so.  Thanks.  Bill Conners

When I noticed the letter last Saturday, I sent an email to the Mayor. Bill W. added the city attorney and Theresa.  So I added those two to my list.  I was hoping to hear back from the mayor.

I agree with you but I think the WHOLE controversy was unnecessary. Starting with the April Council meeting, when council was very critical of the Athertonians. In the two weeks prior to the council meeting Kathy and Smith McKeithen wrote letters to the editor critical of the Athertonians.  The mayor's letter would have come from the town with more several accusations.  

My belief is that had I not questioned the letter prior to the meeting, it might have been approved on the consent calendar.

I did speak under public comments, but also spoke on the tennis courts. So maybe my comments were missed.

Since it was not discussed,  and now dropped how does the Mayor feel about the Athertonians?  Does he still stand by those views in the letter? Does the town still want the Athertonians to change their name?

It is about getting closure.  In April Staff was advised by the council to take action and call a speical meeting if necessary.  Is it all past us?

Additionally, although I respectfully disagree with your accusations that it was “hidden” on consent and believe it to be completely absurd, I encourage you to continue your dialogue with the Town to find out the facts before you send me accusatory emails. My door is always open.

It was my suggestion at the beginning of the meeting to remove the item. I believe the controversy it created was unnecessary.  I noted that anyone who showed up to speak on the item was welcome to discuss it under public comments. I’m sorry you missed that. I don’t see any reason to continually talk about the subject either. In order to get things accomplished we need to yield a more positive attitude to this Town.

Regarding the library donor funds – As I said last night, once Debra and I are complete with our background information and research we will bring it back to Council.

Any reason why you pulled this off the agenda last night?   I sent out an email and people turned out to speak on this item and it was cancelled. It the town was trying to send out an inaccurate, and unfounded letter to discredit and undermine a group that informs residents about town issues. And by having it on the consent calendar,  the town thought no one would notice.

Once it was caught and people were going to turned out to speak, you realized it was going to look bad and cancelled it.

Suggestion put the Library surplus donor funds being kept with the town on the next agenda.

When I read the "draft" letter to the Athertonian moderators, placed on the consent calendar for tonight's meeting, I was alarmed, I felt it to be inaccurate, unprofessional, and undermining. I sent a letter to Bill W on Saturday. Bill W referred me to staff, stating that staff had drafted the letter. On Monday staff responded stating the mayor and maybe a council member made edits. Bill W  emailed yesterday at 2:09pm: "All, I neither wrote nor edited the letter." 

 Then at 10:16pm Bill W. wrote me that he did make edits with the attachment showing the edits. It appears at 8:56pm on Thursday June 14th, he advised Theresa to add  the word "inaccurate" infront of the word accusations. And add the words  "unfounded and unprofessional" infront of the word comments. In my opinion these are major changes.

There is a big difference if people are posting "accurate statements and comments" or "inaccurate statements and unfounded comments". When I asked for documentation to support the statements in the June 14th draft letter claiming "inaccurate" statements, I was told staff would have that documentation since they drafted the letter.

However, staff did not put the words "inaccurate, unfounded, and unprofessional" in the letter, which has completely changed the letter  staff drafted.  I find the  draft letter to be "inaccurate", "unfounded", and "underming" to the residents that have donated their time to allow residents to express their opinion on issues including traffic, sudden oak death syndrome, and the park.

Looking at the site, there are so few postings. I have asked for the mayor or staff to identify any "inaccurate postings" otherwise the town is making "unfounded and unprofessional" comments.

Hi Charles

Having read your latest note to Bill, I see there are some words which you are questioning that I added to the doc.  The attached word doc with track changes  indicates the rough draft I received with the edits I made.  Whilst we can discuss a word addition here vs there, my editorial changes did not modify the factual content drafted by the Attorney's office.  The attorney's office did not go over the letter or overall Athertonian communications with either Theresa or I.

As you know from  my discussions on the wordpress site, and in an earlier email, I am not in agreement that all the claims or views on this website are accurate.  In some cases they are selective, in other cases inaccurate postings are permitted which fuel multiple follow on letters while potentially other letters are rejected for inaccuracies.

Unbiased is unbiased. 

The site is a good communication vehicle.  It has served many in the Town well for a number of years by passing on news and announcements.  Care must be maintained not to cross the line into personal attacks and to keep the messaging as clear with the most factual information.

Dear Athertonians:

The Town of Atherton first reached out to you to address claims of confusion between your group and the Town’s official newsletter, the Athertonian.  Despite a promise of confidentiality from Town staff, you refused to discuss the issues raised by the Town.  As a final attempt, we proposed two reasonable mitigation measures that would reduce the potential for confusion: 1) a more visible disclaimer on the Athertonians website, and 2) a small name modification.  Again you never responded to the Town.  Instead, you immediately released a strongly-worded statement to the media containing a barrage of inaccurate accusations against Town leadership and unfounded and unprofessional comments directed towards individual council members.  Ironically, you took this action while claiming to be “non-partisan.”

While we welcome open discourse on town issues, free speech does not include the right to knowingly disseminate false statements about the Council in an effort to undermine their efforts.  To the extent that you intentionally spread lies about the Council, we will not hesitate to take all possible steps to protect the work we have done on behalf of and for the benefit of all the residents of Atherton.  Although we may disagree on individual issues, we have been and remain united in our commitment to open communication and a healthy political process.

The reason for the slight delay is that I needed information from the Assistant City Attorney who as you can see actually drafted the staff report.  I  now have the background and can respond.  I felt it was important to give accurate information which unfortunately takes a little time.

First of all, the staff report was drafted by the ACA.  The letter was partially drafted by her, but was edited by others, believed to be the Mayor and perhaps a councilmember.  We aren't sure exactly who, but I'm sure the Mayor can fill you in and either way we believe the letter is an accurate statement of the law.

The letter does not accuse anyone of lying.It simply states the fact that should this group fail to exercise appropriate responsibility in posting statements, particularly those patently false or known to be false, then they can be held accountable.  It seemed fair to point this out since this "free speech" outlet is not open to everyone that wants to join and since they run all comments through a moderator, they can control what is and isn't published.  By definition, this is not a users group that facilitates free speech, only that which they feel should be allowed through their filter.  All of which is certainly OK as long as they don't cross the line into patent defamation.  Even public officials have a right to prevent known lies from being published, and it was felt that to avoid any future confusion, it was well within the rights of the Council to make that point known before anyone later claims they had no idea that they were actually responsible for the veracity of the comments they publish.

Neither the ACA or myself have any reason to make any unfounded accusations against this group.  I invite you to re-read the letter which I believe is both fair and accurate.  The Council desire to make clear that they have a right to be treated fairly when opinions slip over into knowingly false statements is their opinion which states correctly a legal premise.  It does not intimate that Athertonians have done so in the past, only that since they moderate comments that are published and restrict access to this site they need to know that they are ultimately responsible for the content of those items that they allow to be published.  Nothing more, nothing less.

On Sunday I wrote Mayor Widmer and yesterday at noon to City Attorney Conners asking for documentation or links to support the letter to be approved tomorrow night accusing the Athertonians of making "Unfounded accusations" against Town Leadership to undermine council efforts.

I received a response yesterday at noon without any documentation. I responded again asking and am disappointed that since then, I have not heard from anyone. 

I am concerned that this letter is making unfounded accustions against the Athertonians to undermind their credibility. Please advise me of any documentation you might have to support the claims in your letter.

Thanks for the reply.

The Athertonians claim to have taken action and made changes per the orginal letter.  The June 14th letter could acknowledge those changes and state they are not acceptible to the council.

The June 14th letter you drafted for the mayor to sign states that the Athertonians   "released a barrage of inaccurate accusations" and three more times uses words such as "unfounded comments" ,  "knowingly disseminate false statements", "intentionally spread lies".  Which is stating 4 times they "spread lies"

Your response to me does not specify any lies they are spreading. Could you specify the lies, inaccurate accusations, unfounded comments, and false statements?

I have been asked by the Mayor to respond to your email to him since it essentially related to legal issues and emails coming from my office.

This matter arose because of apparent confusion regarding the similarity between the Town's newsletter name "The Athertonian" and the name of a users group, "Athertonians."  We believe the confusion to be real, and our own investigation concluded that while a disclaimer was put forth by this anonymous group, it was buried in text and not clearly set out in a manner that would clearly communicate the disconnection between the users group name and the Town of Atherton.  There was either a true link to their site associated with the Town's website or an unintended connection as set forth in the following factual scenario outlined by the Assistant City Attorney.  In any case, our attempts at communicating with this group was thwarted by them, despite multiple efforts to simply open a dialogue to discuss the problems associated with the closeness of the two names.

Is there really any confusion between the two web site?  Both web sites are clear who the owners are. The Athertonians email list only goes out to people who have signed up to receive it. If someone later gets and email from Athertonians @yahoogroups.com after knowingly signing up to get emails, how can they be confused?

I went to the web site and believe the disclaimer to be visible. What is unacceptible to the town?

Just an update re:Little League's proposal to expand the baseball facilities at HPP.

The Planning Commission heard from representatives of M-A Little League. The architect of the project explained the development, and provided sketches and artist renderings. After hearing public comment pro and con, the Commission decided to vote on their recommendation to the council next month. They will wait for the proper wording of their recommendation to be worked out before voting on it at their next meeting.

We hope that your efforts on the Atherton Town Center Task Force will help propel an Atherton Master Plan and more comprehensive designs for the Atherton Town Center and Atherton Library.  

In addition to its location, we questioned the functionality analyses, requirements specifications, and technology deployment in the proposed Atherton Library in Holbrook Palmer Park (email appended).  We now question the functionality analyses, requirements specifications, and technology deployment in the currently outlined conceptual design phase of a new Atherton Town Center.  

Although we fully support the Atherton Town Council architect selection of Nichols Melburg & Rossetto, we believe that functionality analyses, requirements specifications, and technology deployment should be conducted before any funds are expended on the architecture for a new Atherton Town Center.  These assessments should include appropriate benchmarking.  These assessments are just as important as and should influence the Town Center Task Force estimates of space requirements.  Again, form must follow function.

Supporters for a new Atherton library in Holbrook-Palmer Park state that "fears of a huge increase in traffic at the park are unfounded."  So because $8.4 million can be spent in 2015, Atherton has committed in 2011 to build a new library that won't increase library usage…  This is absurd.

Data are critical.  Descriptions and drawings for both the library and town center seem to concentrate on form.  Form must follow function.

The new Stanford University Graduate School of Business library provides just one example of a high technology library integrated within a knowledge center that's part of a larger academic and real world community.  It's comprised mostly of individual and group study spaces on five huge floors featuring electronic access ports and devices.  This new library contains only 10% of all the old library books.  No staff are required for this new library to be open for cardholders on nights and weekends.  At a minimum Atherton should have a library fully integrated with other learning environments; e.g., Stanford University, Menlo Atherton High School, St. Joseph's School.  The new Stanford University Graduate School of Business library provides an extraordinary benchmark for our design considerations:  businesslibrary.stanford.edu

Every major survey of America's education system indicates that America lags other developed nations and that we're continuing to lose our competitive edge in the global economy.  To best provide continuing education for both children and adults, the new Atherton library must offer at least comprehensive integration and ubiquitous access with state-of-the-art technology.  Integrating our library with our town center would also encourage community relationships and leverage our scarce tax dollars.

To secure the support of Atherton voters, we would be wise to provide a comprehensive data-based design alternative to the current proposed obsolete Atherton library and town center concepts.  Atherton needs a world class town center with a community integrated library incorporating state-of-the-art technology.

This Wednesday's Council meeting has two serious items on it. Agenda Items #14 and 21 involve our First Amendment Rights and the second is the long term design and use of our park. Please consider attending and speaking or writing a letter to the town expressing your viewpoint.

Item #14 involves council action regarding the resident blog Athertonians. A letter is on the consent agenda from the town to the moderators of the Athertonians. However, Moderators had previously posted a response to prior accusation made, which are rather illuminating at:http://www.athertonians.blogspot.com/2012/06/answers-to-various-accusations.html#comment-form. What the council is doing can best be described from a May 30, 2012 Editorial: Critique of Athertonians blog is off base by the Alamanc Newspaper.

The council majority of Mayor Widmer and members Jim Dobbie and Kathy McKeithen seems determined to make life as painful as possible for the Athertonians, directing city staff to urge its anonymous moderators to change the group's name, and if they don't, prepare to take legal action. At the council's April l8 meeting, Mr. Dobbie said, "It's high time we do something."

But to myself and many others in Atherton, the name "confusion" is a red herring. The real problem the blog presents to the council majority is its throwing light on the town's plan to build a new library in Holbrook-Palmer Park and get people not to notice or think they can't do anything. In this case, the First Amendment rights of the Athertonians clearly trump any upset felt by the council members or city officials about the blog's content or the possible confusion from the similarity of names to The Athertonian.

Any judge would want to know why the city is just now objecting to the confusion, eight years after the blog was created. In this situation, it appears that the council majority is rowing upstream against an increasingly vociferous group of residents who appreciate the Athertonians as an effective communications tool.

Item #21 is to spend $18,000 to do a phone survey of 200 residents regarding placing the library in the park and other park issues, perhaps removing the tennis courts. The words in the survey will likely have to be approved by a council, of which three members have already stated their support to move the library to the park. But will a survey do the job at this point? I think not.

Let both sides write their statements in favor of a county library in the park or opposed to a county library in the park. Does the council expect to learn anything new from calling 200 residents? For months hundreds of residents have been expressing themselves through council meetings, writing letters, online surveys, and signing petitions, which they have chosen to ignore. Why not listen to the opinions already expressed or call a special town meeting to address demands for a vote? Use the $18,000.00 for this town wide vote on the November ballot, which will resolve all the controversy. Candidates for council can make the library in the park part of their platform.

Answers to Various Accusations

Accusations by Opponents to the Athertonians Email Group

1.  Does Athertonians censor opposing views?

Answer:  No we don't. We seek to support open communication between residents.  However, after a message from Ginny Niles, a member of the ALBSC, was posted last fall containing highly inaccurate and misleading representations about the Library project, we got complaints about approving propaganda that does a disservice to the residents of the town.  We elected at that time to reserve the right to not approve messages deemed misleading or untruthful, no matter who they are from. 

2.  Does Athertonians refuse membership to certain residents?

Answer:  Ordinarily, no.   However, we do reserve the right to only approve those residents whose interest in being members are in conformance with our purpose for being, which is open and factual communication between residents.  When individuals seek membership for the purpose of attacking us or undermining the functioning of the group, we will refuse their memberships.

3.  Is the Athertonians refusing to help reduce the possibility of name confusion?

Answer:  No, when notified, Athertonians did modify the Athertonians Logo to add more clarification about who we are and our purpose.  We are otherwise unable to modify the Yahoogroups website.  Because the only possible confusion is between a infrequently published newsletter called "The Athertonian" and our email list and blog, called "Athertonians" we think the issue as well as incidence of actual confusion is rather minor.

4.  Athertonians refused to discuss issues of concern to council members with the Assistant City Attorney regarding changing our name, who promised us confidentiality.

Answer:  Yes, that is correct.  We have been moderating this list for 8 years, in all of which time, we have had no complaints from residents about any confusion about us.  Then, to our surprise, we received a brief flurry of hostile messages from people claiming to be confused about us on Thursday, May 3rd and Friday, May 4th.  Shortly after that we received the below letter from the Assistant City Attorney, Ms. Jennifer Larson, who wrote "We continue to receive reports of confusion by residents who erroneously believe your Athertonians yahoo group and blog are in some way connected to the Town of Atherton."  Ms. Larson knows very well none of those complaining on Thursday (most of whom are known to be affiliated with the ALBSC) were actually confused. Rather, they seemed to be attempting to build a legal case against this group.

We continue to receive reports of confusion by residents who erroneously believe your Athertonians yahoo group and blog are in some way connected to the Town of Atherton.  As you are likely aware, the Town's newsletter, which has been in existence longer than your yahoo group and which is available online, is named "The Athertonian."  A good example of the potential for confusion is that a simple google search for "Athertonian" produces, within the first few results, "Athertonians: Community Notices for Atherton Residents," which is a link to your yahoo user group.  It is not difficult to see how an ordinary person could reasonably believe that your group is affiliated with or representing the Town itself.  This confusion is particularly problematic where residents have thought that politically-charged statements sent via your yahoo group are being disseminated by the Town, instead of by private individuals. 

While we respect your right to create and maintain such an efficient vehicle for neighborhood communication and discussion, it is in all of our best interests to find a way to resolve this growing confusion. 

To that end, we propose that you amend your group name to remove the almost complete overlap between "Athertonians" and our official Town newsletter, the "Athertonian."  For example, names such as "Atherton Residents" or "Athertonians Together" create more of a distinction between the two unrelated news sources, and indeed would have the ancillary benefit of clarifying your group's purpose.  In addition, we feel the disclaimer currently appearing on your home page is obscured by text and should appear more prominently at the top of the page, and perhaps in bold or colored text. 

Please understand that we have no interest in preventing political or other discourse between private individuals: We seek only to protect the concerned residents who have been (or will be) confused by the name of your group.  We feel that the two aforementioned small changes could be sufficient to meet that goal.

5.  Did Athertonians unsubscribe some members because they hold different opinions? 

Answer:  Yes, we unsubscribed ten members but not because they hold different opinions.  After Ms. Larson sent us a message threatening possible legal action, we recognized that our group was under legal attack by Councilmember McKeithen and her ALBSC committee (who were the same folks who claimed name "confusion" above) presumably because of our interest in making sure residents get accurate information about their EIR rights and the controversial library project.  Since they were attacking us and our very purpose, we felt that they no longer should enjoy the privilege of having membership in our group — which entitles members to have facilitated communication with the town.  We then unsubscribed members of the ALBSC and refused a membership request from Mr. McKeithen for obvious reasons.  This is something we've never done before to any member.  However, given that the ALBSC has access to a reserve of nearly $6 million available for their purposes (plus the small fact that they opted not to use the Athertonians list to provide outreach for any of their library meetings, when doing so might have helped inform more residents of the town), we felt justified in removing them from the list.

You all may be aware of what is happening with the City Council regarding the Holbrook-Palmer Parks tennis courts.  Currently the City Council is looking at three options, closing the courts due to the poor surface conditions and the small number of keys sold, using the space for the new library,  or possibly resurfacing them.  

This is a very crucial time.  Shirley Carlson, the President of the Holbrook-Palmer Foundation suggested that we all attend the meeting on Wednesday, June 20th at 7pm at the Atherton Town Hall on Ashfield Ave.  Please plan on joining us and bringing your family, friends and neighbors, whether you own a key or not to support the courts in the park!

I believe it was at the December 2011 Council Meeting you abstained on the motion to follow the Recommendation of the Park and Recreation Commission to have a survey or vote of the residents of Atherton regarding moving and expanding the library to Holbrook-Palmer Park. Needing three votes to pass the motion failed 2-2-1. Councilmembers Lewis and Carlson were in favor with Dobbie and McKeithen opposed. Normally Atherton council meetings have few people attending, this meeting had scores of people advocating the town vote.

Previously you were part of a 3-2 vote to move the library to the park. You replaced me after I retired from the council in December 2010 after eight years. I would have voted to allow the residents of the town to vote on the matter. You should consider that former council members Fisher, Janz, Dudley, would have also allowed the town to vote on the issue. In fact there not one former council member or Mayor that would not have allowed the town to vote on the matter.

I encourage you at the June council meeting to announce you want to move your vote from "abstaining" to "in favor" of a town vote.

Granted Atherton has more than $5,000,000 in reserves that has to be used for a library purposes. My understanding is that moving the library to the park will require a traffic light on Middlefield and turn lane at El Camino. Can library funds be used for traffic signals, road expansion and upkeep?

The Park shuts down at sunset, which is 5pm in the Winter. The library is open past 5pm. Can library funds be used for the extra police services needed to support the larger library and those who will stay in the park after sunset?

At the April council meeting I proposed that Atherton simply use the funds to improve the current library. If it makes sense consider these other uses with the surplus:

1. Do a joint venture with Menlo College (San Jose did this with San Jose State). Expand the Menlo College Library and have Menlo College offer classes to Atherton residents at a reduced rate.

2. The library has done a great job with events. Use some of the money to connect current council chambers to the existing library to be used as an auditorium for those events.

3. Atherton has a great history, use some of the money to display Atherton heritage.

Maybe these ideas are not the view of a majority of the residents of Atherton. However they were not reviewed and it is clear that a large number of residents do not favor placing the library in the park.

For the council to have spent hundreds of thousands of dollars in EIRs and other studies to move the library to the park without spending the few thousand dollars to do an electronic survey of the residents or a mail in vote is not prudent and is not being a good steward of the town's assets.

Remember your web site and campaign slogan "Expect More...Budget Minded Independent Listening Leader." Listen to desires of the residents of Atherton and lead by not abstaining on a vote to provide for a town vote on the library in the park. Vote "Yes" on the survey and listen to the voice of the people.

With much respect to all who have had opinions on the draft EIR, a democratic process does not require a vote (plebiscite) on Town issues, and in particular this issue. In fact this kind of issue is a very  poor choice on which to have a plebiscite. The Council set up a process, which has been working for over two years, analyzing in depth the concerns and issues. Clearly there is no perfect solution. But if we think a 'vote' can substitute for the careful analysis done and still being done, we are sadly mistaken. A vote would merely bring forward the pet peeves of our residents rather than a considered analysis of what makes sense for the long term. I note that even our neighboring municipality, Menlo Park, seems to have no cry for a vote on the Facebook issues.

Those who love Holbrook-Palmer Park wish to 'protect' it. Those who feel the current location is unsafe (we are certainly due for an earthquake) and very noisy prefer an alternate site. However, a 'vote' cannot possibly allow the citizens to individually command the amount of knowledge that has been built up through the appointed Commission and Council members with full opportunity for citizen comment and input. With that knowledge now being put before the full Council, the Council members are duty bound to do what we elected them to do: make a hard decision. Taking the risk of kicking this can down the field is clearly not a good choice, particularly when we consider the continuing danger of an earthquake and possible injury to library patrons. It is  particularly worrisome for children who use the library. Why would we as residents want to go to considerable additional expense, risk and potential liability so the Council can avoid a decision?

The issues, which Mr. Marsala raised, assuming they were raised in the DEIR process, will be considered. They are not insignificant, but I would be surprised that they are not capable of being addressed. The Minutes for the December Council Meeting were not available in the archived records, but my own recollection was that the focus was on a survey, not really a vote. It is not unusual for legislative bodies to work through assigned committees or sub-committees to explore an issue, but when do we hear of  legislatures sending an issue back to the electorate? I cannot help note Mr. Marsala's not quite accurate statement referring to these funds as belonging to Atherton. Atherton does not have over "$5,000,000 in reserves". San Mateo County's Library governing body, the Joint Powers Board, has final say over the approximately $5,000,000 dedicated for use in building a library in this community. A good argument can be made that if a vote is held, in light of the fair and democratic process used so far that Atherton and its residents will have overstepped their authority with regard to the Joint Powers Board. Mr. Marsala refers to "scores" in the last sentence of the first paragraph. A "Score" is "Twenty"; there were not a number of "Twenties" advocating a town vote. I was there and would be much surprised if the 'pro-survey/vote' advocates added up to even ten residents. Much is exaggerated in the comments of the anti-Park advocates. Where were they during the two years when information was being gathered?

All of the former council members mentioned expressed oppostion to the proposal to put the library in the park - but their opposition is not clear or at all detailed.  They claim to love the park and want to protect it - protect it from what precisely?  A lovely new public library that will replace an aging building of limited use.  A public library would participate in providing valuable programs for the community; a public library would help to improve and maintain the park.  As it is now the community struggles to maintain the park; the Holbrook-Palmer Park and Atherton Dames struggle to raise money for improvements.  It seems that the town, the park and the library would all benefit by the project moving forward. Some people praise the peacefulness and greenery of the Park and fear its possible detriment because of a library being placed there. But does that make sense in light of the peacefulness of the current library scene. It might be a good argument, if we did not have a surfeit of greenery and wild spaces in the town itself and in the hills to the west and south.

Do the former council members really want to be remembered for being instrumental in preventing what is a wonderful project for our community from going forward.  The story of how the library came to be will be put in a time capsule to be opened in 50 or so years.  And at that time - that capsule will be either opened at a library in a  beautifully maintained arboretum like park - or a space a few hundred feet from a rail line - and one might surmise that the rail line might be greatly changed. And that is part of the point, we hope that our leaders make tough well studied decisions for the betterment of our community's future.  It is puzzling, because we have yet to hear - why the library in the park will not benefit the park - and why keeping it where it is is better for the library and the community.  It would be very helpful to hear that, rather than just a drumbeat for a vote.

The continued ad hominem and biased statements and exaggerations my those urging a vote hardly does honor to the Town's civil image. I urge all the Council members to not necessarily stand on their earlier views, but to consider the comments and responses to the DEIR and use their best judgement on the basis of the democratic process they instituted over two years ago. Do the Council members really need a vote of all residents to take them off the 'hot seat' or to disagree with former Town officials? That is why you stood for election to the Council.

Walter,
What to do with the library reserves is an interesting process for Atherton. I spent six years representing Atherton on the San Mateo Library Joint Powers and have great respect for the members of the Friends of the Atherton Library. I have worked with the Friends on many projects both regarding the library and in other areas to benefit the community such as Art in Action. I do however side with the Park and Recreation Commission that a survey or vote is needed before changing the Park forever based on a slim 3-2 council vote.  
I do stand by the statements in my letter which you challenge and use the following as back-up.
1A. The Benefits of a Survey or Vote: Twice the council town has surveyed residents on how they want the park used. In 1959 before the town accepted the donation of the park land, it surveyed the residents- it is called the Kroger report. There is a 126 page study that was done in 1959 by Robert Fulton Carmody Jr. titled: "An Island in Suburbia: The Study of Atherton, California, an Upper-Class Residential Community Resisting the Impact of Urbanization." The study describes the politics going on in Atherton regarding the town and the park.  
Fifty-three years later not much has changed in Atherton. The Study should be made into an e-book so that everyone in Atherton can read it. A few side notes from the study:
 Page 89- "a group of citizens in Atherton's northeastern corner are engaged in a battle to get out of the Redwood City Elementary School District."
Page 98 - Talks about opposition to doing the survey on the Park and those not wanting the survey. "They made a number of references to the "old guard," "the West Atherton Moguls," and the "old Athertonians."
Page 83 - "The wrath of the "old guard" may have driven many a scheming developer from Atherton but the ordinary citizen seeking a variance does not deserve such harsh treatment."
Once the Kroger report was published the council changed its viewpoint. From Page 104: "All of the councilmen have made statements similar to Nathan Most's that "We're dealing with a different community than we thought we were, and we've got to change our attitude on a number of things." They were not sure of where to go from here. They say that they want to do what is right for the community and their actions indicate that they are sincere."
Back to 2012. A survey or vote is not expensive, if it comes back the majority of the town favors the library in the park, then the project will have great community support, because those opposing it will know they were heard. The library in the park will bring the community together.  
But if a majority of the residents do not favor the library in the park, then that should be viewpoint should be accepted.
The November election is only a few months away. Wouldn't it be so easy and better for the town for this to be on the November ballot? The council puts it on the November ballot and candidates for council make it one of their campaign issues.  Once the election is over both sides support the outcome and those elected to council.
1B. The EIR does not and will not address the benefits of a Joint Venture Library with Menlo College. Menlo Students have to do community service and Menlo College desires to build its reputation in Silicon Valley. A better library offering classes to Atherton Residents would be a win-win. Would Atherton residents prefer spending some funds to improve the exisiting structure and the rest for a Joint Venture with Menlo College over to a larger library in the park- the only way to know is to do a survey or vote. The residents of the town do not approve of the "library study sessions" for location of the library. It needs to be on the Council Agenda. 
Menlo Park has put several issues to the voters to decide. Other issues have been agenda items at council meetings.  What if the council had an agenda item that would allow broad discussion on the topic: "What to do with the $5,000,000 in Library reserves?" 
Since more than 50% of the people that use the library come from outside Atherton. Expanding to the Menlo college library would make it easier for the college students to tutor children from Fair Oaks. There is a bus stop at the college, so getting to the library would be "Greener" and less of a transportation issue than having the library in the park.

I disagree with you. The $5,000,000 comes from Atherton Property Taxes and can only be used in Atherton with the approval of the Atherton Council. The JPA agreement reads that any decision would be approved by both boards.  The JPA cannot tell Atherton to build a library in the park.
If Atherton decided to do a Joint Venture with Menlo College, could the JPA decide not to provide support and oversight to the project? I guess they could. But why would they oppose?
Currently the county transfers the surplus to Atherton for Atherton to hold in Atherton reserves. It has been published on this blog that a JPA agenda suggests that the JPA retain the Atherton surplus in the future. It does not say whose idea this is. Did the Atherton council request the JPA start keeping the Atherton surplus or did the JPA?
I am surprised that this was not an agenda item for the Atherton council to discuss and recommend how the current JPA representative Council Member McKeithen should vote on the item.   There are benefits for Atherton to continue having the JPA transfer the surplus (more than $500,000 annually) for Atherton to keep in its bank account as opposed to letting the JPA start an account just for Atherton.
3. The November 23, 2011 Almanac story states that "...nearly 50 people filed seats in Jennings Pavilion...
Resident John Ruggeiro said people in Atherton fall into three groups regarding the library site. Some want it in the park, some want it in a new town center complex, and some want it where it is now.

He then asked those in the room to raise their hands if they favor a survey on the library site. Three-quarters of those in room raised their hands." "
75% of 50 people is 37.5 people. Now I am sure it was not exactly "three-quarters of those in the room" as reported. I believe I saw more than 40 hands, which would make "scores"  acurate.  Could "Nearly 50" mean "55" people?
On the reverse side. What this shows is that approximately only 25% or less than 15 people at the meeting do not favor a survey or vote on moving the library to the park.  A survey of the Athertonian's email list had almost 200 respond with a similiar result - 25% favor moving the library to the park.

One thing is clear in Atherton right now: Residents have not come to an amiable agreement about whether their new library should be built in town-owned Holbrook-Palmer Park.
Some are even talking about putting the issue on the ballot for the voters to decide.
Where to site the library was back before the council for the third time in a month at the Nov. 16 council meeting, and nearly 50 people filled the seats in the Jennings Pavilion in Holbrook-Palmer Park.
The council had two items on the agenda that directly affect the library and one other that could indirectly affect it.
The first was surveying the town's residents to get their opinions about where the library should be placed. The second was authorizing an environmental impact report needed so the library project can go forward. The third is whether the town should resume renting out the park for events, an action that could use up parking spaces that may eventually be needed by the library.
The survey was on the agenda, even though some council members felt they had disposed of it last month, because it was a recommendation from the town's Park and Recreation Committee and town rules require such recommendations be discussed and voted on.
Councilwoman Kathy McKiethen, who is on the committee that came up with the recommendation to put the library in the park, had a two-page summary of the reasons she is against a survey. Among the reasons was that, due to complexity of the issue, "it would be impossible for a resident to make a knowledgeable response to the supposedly simple question 'do you favor a library in Holbrook-Palmer Park?'"
That didn't sit well with some in the audience. "When I am told that the issue is so complex that I shouldn't worry my little head, then I can't decide whether to be insulted or suspicious," resident Jonathan Tiemann said.
Earl Nielsen agreed. "We can't trust the intelligence of Atherton รข€” you're kidding?" he said.
Ms. McKiethen insisted that she had not meant that, however. "I didn't say the people of Atherton aren't smart," she said.
Resident John Ruggeiro said people in Atherton fall into three groups regarding the library site. Some want it in the park, some want it in a new town center complex, and some want it where it is now.
"We need a survey," he said. "It's very obvious we need a survey."
He then asked those in the room to raise their hands if they favor a survey on the library site. Three-quarters of those in room raised their hands.
There were those in the room who did not support a survey, however. "It is time to move on and not try to keep changing that decision," said Karen Bliss, president of the Friends of the Atherton Library.
She suggested that those who don't agree with the council members who chose the park as a site, can "throw the bums out" at the next election. "I'm embarrassed to live in Atherton," she said "Lately I think some of the behavior exhibited in this town is downright shameful."
Walter Sleeth also opposed a survey. "This issue has gone on ad nauseam," he said. "The quiet majority of residents believe .... that a survey vote is a waste of town resources."
